  • Regulatory Status: Cruise Retail Academy Ltd acts as an Employment Agency as defined under the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (the "Conduct Regulations") in respect of the recruitment and placement of Candidates for permanent direct hire by our Clients.

By accessing our website, using our "E-Academy" training materials, or registering as a Candidate, you agree to be bound by these Terms and Conditions.

These Terms and Conditions apply to all Candidates (Seafarers) using the services of Cruise Retail Academy. By registering on our platform, accessing training, or applying for a vacancy, you agree to the following provisions:

1. INTELLECTUAL PROPERTY & PROPRIETARY MATERIAL

​

All content provided on the Cruise Retail Academy website and platform, including but not limited to text, graphics, videos, audio, presentations, documents, and any other materials (collectively, the "Course Materials"), is the intellectual property of Cruise Retail Academy and is protected by copyright and other intellectual property laws.

You are strictly prohibited from:

  • Copying, reproducing, or distributing any part of the Course Materials in any form or by any means, whether electronic, mechanical, photocopying, recording, or otherwise.

  • Modifying, adapting, translating, or creating derivative works based upon the Course Materials.

  • Sharing your access credentials with any other individual.

  • Using the Course Materials for commercial purposes or for the benefit of any third party without the express written consent of Cruise Retail Academy.

  • Claiming ownership of any part of the Course Materials.

This training content is for your personal educational use only. Any unauthorized use, reproduction, or distribution of the Course Materials may result in legal action and immediate termination of your account.

2. NO FEES FOR RECRUITMENT (MLC 2006)

​

In accordance with the Maritime Labour Convention (MLC) 2006, Cruise Retail Academy operates a strict no-fee policy for recruitment.

  • No Charge for Placement: We will never charge a Candidate a fee for recruitment, placement, or for providing employment.

  • Optional Training: Fees paid for "E-Academy" subscriptions or Course Materials are for professional development only. Purchasing these materials is entirely optional. It is not a requirement for recruitment, nor does it guarantee employment or provide preferential treatment in the hiring process.

3. COSTS BORNE BY THE SEAFARER

​

The only costs that may be borne by the Candidate are:

  • National statutory medical certificates (e.g., ENG1).

  • Personal travel documents (e.g., Passport, Seafarer’s Book, Visa).

  • Personal criminal record checks.

  • STCW certication

​

4. CANDIDATE RIGHTS & FINANCIAL SECURITY

​

  • Informed Consent: You will be given sufficient time to examine your Seafarer Employment Agreement (SEA) and seek advice before signing.

  • System of Protection: Cruise Retail Academy maintains a system of protection (via insurance) to compensate Candidates for monetary loss incurred due to a failure by the Agency or the Shipowner to meet obligations under the SEA.

  • Repatriation: We verify that Shipowners maintain insurance to protect you from being stranded in a foreign port.

5. ETHICAL CONDUCT & DATA PRIVACY

​

  • Non-Discrimination: We do not use "blacklists" or mechanisms intended to prevent qualified Seafarers from gaining employment.

  • Data Usage: Your data is processed per UK GDPR and shared only with prospective Shipowners for the purpose of securing employment.

6. COMPLAINTS PROCEDURE

​

If you have a complaint regarding our services, please contact our support team using the contact details below. We will acknowledge your concern within 5 business days. Unresolved matters may be escalated to the Maritime and Coastguard Agency (MCA).

 

7. GOVERNING LAW

​

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

 

8. ENTIRE AGREEMENT

​

These Terms and Conditions constitute the entire agreement between you and Cruise Retail Academy Ltd with respect to your use of our Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

 

9. SEVERABILITY

​

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision will be struck from these Terms and Conditions and the remaining provisions will remain in full force and effect.

 

10. AMENDMENT

​

We may amend these Terms and Conditions from time to time by posting the amended Terms and Conditions on the Website. Your continued use of our Services after the amended Terms and Conditions have been posted will constitute your acceptance of the amended Terms and Conditions.
